Your data privacy is extremely important to us - it’s your data, not ours. In this policy, we explain what data we collect, why we collect it, how it is handled and used, and what rights you have regarding your data. Rest assured, we will never ever sell your data even if offered lots of money because although money is nice to have, bad karma isn’t.
This policy applies to our handling of information about site visitors, prospective customers, customers, and customer’s Recipients. We, Fallbacks.io, refer collectively to these categories of individuals as "you" throughout this policy.

Our core principle is to collect only what is necessary. Here’s how that looks in practice:
Identity and access
When you sign up for an account with Fallbacks.io, we ask for identifying information such as your name, email address, address, phone numbers, social accounts, and date of birth. However, you have the option to not provide all this information as only a name and email address is required in most cases to use our Services. Any information you provide will be used to provide Services to you. For example, we may use your identiying information to verify relation with Recipients who you designate as beneficiares in your automated Digital Will.
We also provide the option to sign up for an account through OAuth providers such as Google and Facebook. During the transaction, we only request minimal scopes to use our Services. We do not store any access tokens provided from such providers, but do store your name and email address.
Billing information
If you sign up for a paid subscription with Fallbacks.io, you will be asked to provide your payment and billing information such as credit card and billing zip code. Credit card information is submitted directly to our payment processor, Square, and does not hit our servers. We store a record of the payment transaction provided from Square in a form of Invoice data but do not store your credit card information at all. During the payment transaction, we share with Square your email address that you used to sign up for an account.
Product interactions
We store on our servers the content that you create, upload, share, receive or maintain in your Fallbacks.io account. This is so you can use our Services as intended. We keep this content as long as your account is active. If you delete your account which you can freely do so within your Account Settings, all your content will be deleted and unrecoverable immediately.
General Geolocation data
We log the full IP address used to sign up for an account and fingerprint your device for purposes such as identifying new users and fraud migitation. We also log all account access by full IP address and device fingerprint for security purposes.
Website interactions
We may collect information about your browsing activity for analytics and statistical purposes, such as testing conversion rates and exploring new product features. This may include details like your browser and operating system versions, IP address, pages you visited, how long they took to load, and the website that referred you to us. If you have an account and are signed in, this data is linked to your IP address and user account until you delete your account.
Advertising and Cookies
We may run contextual ad campaigns on various third-party platforms such as Google, Reddit, Facebook, etc. Users who click on one of our ads will be sent to our homepage or landing pages. Where permissible under law, we may load an ad-company script on their browsers that sets a third-party cookie and sends information to the ad network to enable evaluation of the effectiveness of our ads, e.g., which ad they clicked and which keyword triggered the ad, and whether they performed certain actions such as clicking a button or submitting a form.
Voluntary correspondence
When you email Fallbacks.io with a question or to provide feedback, we keep that correspondence, including your email address, so that we have a history of past correspondence to reference if you reach out in the future.
We also store information you may volunteer, for example, written responses to surveys. If you agree to a customer interview, we may ask for your permission to record the conversation for future reference or use. We will only do so with your express consent.
We process and utilize your personal information for the following essential business purposes to ensure the proper delivery of our Service:
- Personal identifiable information that you provide will be used throughout our website to provide, operate, and maintain services rendered offered by our features such as Actions.
- We may communicate with you via email, SMS, or other forms of contact such as phone call or direct mail to keep you updated with your Account, subscription, new features, events or changes that may occur in the future. These communications are usually not marketing related and sole purpose is to only keep you informed. If an opt-out is available, you will find that option mentioned in the communication itself or your Account Settings.
- We will communicate with you via email to remind you of upcoming check-ins for Triggers you have created.
- If you are a Recipient (beneficiary), we will communicate with you via email, SMS, or other forms of contact such as phone call, direct mail, or social media platforms to inform that you are a Recipient of one of our customers once an Action is processed after a Trigger is executed.
- If you are a Recipient, before accessing any Secured Access documents or assets entitled to you from one of our customers, we will use your information to verify your identity. Depending on the situation, we may run background checks to confirm your identity against official records to mitigate fraud.
- If you have a subscription plan, we share your email address that you used to sign up for an account with our payment processor, Square. No other identifiable information is shared with Square. You will receive an invoice email from Square after a transaction for your records.
At Fallbacks.io, we are committed to extending the same data rights to all our customers, no matter where they are located or subscription plan. These rights include:
- Right to Know: You have the right to be informed about the personal information that is collected, used, or shared. We provide a clear outline of these details in this Privacy Policy.
- Right of Access: You have the right to access the personal information we collect about you, as well as to obtain details regarding how that information is shared, stored, secured, and processed.
- Right to Correction: You have the right to request correction of your personal information.
- Right to Delete: You have the right to request us to delete any personal information that you have volunteered. You also have the ability to fully delete your account at any time. All deleted data is unrecoverable and immediate when processed.
- Right to Complain: You have the right to file a complaint with the relevant supervisory authority regarding how we handle your personal information.
- Right to Restrict Processing: You have the right to request restrictions on how and why your personal information is used or processed, including the option to opt out of the sale of your personal data. Again, we will never ever sell your data. This is mentioned just for legal purposes.
- Right to Object: You have the right, in certain situations, to object to how or why your personal information is processed.
- Right to Non-Discrimination. You are human being, we no right to discriminate you in any way. We do not and will never charge you a different amount, offer discounts, or give you a lower level of customer services because you have data privacy rights entitled to you not just by law but by the universe.
Many of these rights can be exercised by signing in and updating your account information. If you have any concerns, questions, requests, or complaints, please contact us at support@fallbacks.io. If an authorized agent is corresponding on your behalf, we will need written consent with a signature from the account holder before proceeding.
In the event that we may deny a request, you have the right to appeal our decision. If applicable by law, you have the right to lodge a complaint with a supervisory authority as well.
Security and Privacy is paramount at Fallbacks.io. All data transmitted from our servers to your browser is encrypted via SSL/TLS. When your data is at rest, we go to great lengths to keep it private and secure as well. When you upload any sensitive documents for Recipients, you have the option to encrypt the document with Password Derived Key which means that your document will be encrypted on your browser before it is sent to our servers for storage as a form of End-to-End encryption.
At any given time, you have the ability to delete a single piece of Content or your entire Account without any formal requests within your Account Settings. If you wish to delete your Account, keep in mind that this is irreversible and immediate.
If your Account has not seen activity for 365 days with no Triggers executed or scheduled to be, it will be assumed that you are no longer interested in our Services anymore. We will take appropriate steps to confirm this and will schedule your Account to be deleted if deemed so.
Rest assured, we understand the nature of our Services. In the event of inactivity that suggests you may be or are incapacitated, we will keep your account active for as long as necessary to ensure that all of your Recipients are informed of your legacy. This is our commitment to you.
We retain your information only for as long as necessary to fulfill the purposes for which it was collected and provide the Services that you have requested. The duration of retention depends on the specific purposes for which we use it and your preferences. After this period, we may delete or archive the information. Additionally, we may retain and use your data as required to meet legal obligations, resolve disputes, and enforce our agreements.
We operate our business from the United States in which many of our web assets such as servers, storage, etc, are primarily housed in the United States. If you are located outside of the United States such as the European Union, United Kingdom or elsewhere, please be aware that any information you provide to us will be transferred and stored in the United States. By using our website, product, or services you consent to this transfer.
We may update this policy as necessary to comply with applicable regulations and to reflect any changes in our practices.
